Community Sports Club Subsidy Scheme - Conditions of Grant

In accepting the grant, a CSC must observe the following conditions:

(1)

All publicity materials (including publicity banners, posters, leaflets, brochures, invitation cards, press releases, prizes and souvenirs) must indicate that the programme is co-organised by the respective NSA with subsidy granted by the LCSD. The CSC must notify the LCSD and its respective NSA of all publicity plans and designs of publicity materials;

(2)

The CSC must not make a profit from running the programme;

(3)

The subsidised programme must not be used for personal publicity purposes;

(4)

The CSC must inform the LCSD and its NSA of any accident within 12 hours of its occurrence;

(5)

The list of participants shall be prepared and submitted to the LCSD and its NSA by fax or mail at least one week prior to the commencement of the programme;

(6)

To ensure the programme quality, the instructor(s)/person(s)-in-charge of the programme should inform the participants in the first lesson that the latter may contact the organiser, the respective NSA or the LCSD for any suggestions or recommendations;

(7)

The course instructor(s) shall be recognised by the respective NSA;

(8)

With regard to the approval mechanism and declaration system, the CSC shall abide by the Code of Conduct and Procurement Guidelines set by its respective NSA to avoid conflicts of interest. Failure to do so may result in a reduction in or cancellation of the approved subsidy for the programme by the NSA;

(9)

The representatives of the LCSD and the NSA reserve the rights to attend all preparatory meetings in an effort to monitor the progress of the subsidised programme;

(10)

The CSC shall notify the LCSD and respective NSA of any changes to the subsidised programme (such as the programme date, time or venue);

(11)

If the number of enrolments is less than 50% of the intake quota, the programme shall be postponed or cancelled;

(12)

The enrolment fees collected for the programme should be able to offset 15% or more of the total programme expenditure;

(13)

In arranging public liability insurance for the programme,

  1. the NSA/CSC shall take out a public liability insurance for the programme in the joint names of the Government of the Hong Kong Special Administrative Region (the Government), the NSA and the CSC with an insured sum of not less than HK$6.5 million for the occurrence of any single accident and unlimited amount for the programme. The insurance policy shall cover liability to pay damages and compensation for injury to or death of any person and for loss of or damage to any property where such injury, death, loss or damage is caused by or arises out of any act, omission or negligence of the Government, the NSA or the CSC or any of the CSC’s employees or agents. The NSA/CSC shall ensure that any public liability shall be adequately covered by the insurance policy;
  2. the NSA/CSC shall provide a copy of the insurance policy two weeks before the commencement of the programme for verification;
  3. the LCSD shall not be liable for any claims, demands or liabilities associated with the organisation of the programme;
  4. the CSC shall indemnify the LCSD against all actions, proceedings, claims, costs and expenses whatsoever in respect of any injury or death arising out of the programme for which the LCSD shall not be held liable;

(14)

When organising the programme, the CSC shall observe the laws and ordinances promulgated by the Government, such as the Prevention of Bribery Ordinance, the Immigration Ordinance, the Personal Data (Privacy) Ordinance, the Copyright Ordinance, etc.;

(15)

The committee members of the CSC shall be advised to avoid conflicts of personal interest with their official duties in the CSC, and to declare any such conflicts in the past, present and future to the CSC. The CSC shall then make an early report to the respective NSA and the LCSD;

(16)

The following information shall be submitted to the respective NSA within one month upon completion of the programme for verification and settlement:

  1. Part I of the Statement of Accounts;
  2. Programme Evaluation Report;
  3. original receipts including the statement of expenditure on the remuneration of part-time staff;
  4. a full list of participants and attendance record;
  5. the photographs and publicity materials of the programme;

(17)

The Statement of Accounts shall be affixed with the organisation’s seal and certified by the Chairman and Secretary/Treasurer of the CSC;

(18)

The originals/copies of the relevant receipts shall be affixed with the organisation’s seal. For procurement of individual items/services of value exceeding HK$3,000, the relevant receipts, accounts or information shall be countersigned by the Chairman and Secretary/Treasurer of the CSC for verification;

(19)

The use of the subsidy is subject to the ceiling as specified in the breakdown of the programme expenditure approved by the respective NSA; and

(20)

The LCSD and the NSA reserve the rights to inspect the accounts of the CSC and to examine the receipts related to the programme.
